The use of the services of mogrexhost.com (MogrexHost Services) constitutes acceptance of these terms.
1.) Account / Email settings in the file *
We will set up your account once we have received the payment and we and / or our payment partners have examined the orders in case of fraud. It is your responsibility to provide us with an email address that is not @ the domains in which you are registering. If there is ever an abuse problem or if we need to contact you, the primary email address registered for this purpose will be used. Each hosting company is configured differently, and some hosting platforms store data in an incompatible or proprietary format, which can make it extremely difficult, if not impossible, to migrate some or all account data. We will do our best, but in some cases we may not be able to help you transfer data from a previous host.
Free transfer services are available for 30 days from the date of registration. Transfers outside the free 30-day period will incur a charge; Contact a member of the support department with specific details to receive a quote.
2.) Content *
All services provided by mogrexhost.com can only be used for legal purposes. The laws of the Lagos state government and the Federal Republic of Nigeria apply.
The client agrees to indemnify and disclaim mogrexhost.com from any claim resulting from the use of our services.
The use of our services to infringe any copyright or trademark is prohibited. This includes, among others, the unauthorized copying of music, books, photographs or any other copyrighted work. The offer to sell any counterfeit merchandise of the owner of a brand will result in the immediate cancellation of your account. Examples of unacceptable material on all shared servers and resellers include:
IRC Bots, Proxy Scripts / Anonymizers, Pirated Software / Warez, image services, file downloads, mirrors or commercials (similar to rapidshare, photobucket or commercial ad rotation), affiliate servers, top sites, commercial audio streaming ( more than one or two flows), trust, high performance interest programs (HYIP) or related sites, investment sites (FOREX, egold exchange), sale of any controlled substance without prior proof of appropriate permits, AutoSurf sites, bank obligations, bank Obligation negotiation programs, Prime Banks programs, lottery sites, muds / rpg’s, hate sites, hacker-focused sites / files / programs, or sites that promote illegal activities, IP scanners, force programs gross, mail bombers and spam scripts. The use of a shared account as a backup / storage device is not allowed, with the exception of a cPanel backup of the same account.

Violations will be reported to the corresponding law enforcement agency.
It is your responsibility to ensure that the scripts / programs installed in your account are secure and that the permissions of the directories are configured correctly, regardless of the installation method. When possible, set permissions on most directories at 755 or as restrictive as possible. Users are ultimately responsible for all actions taken in their account. This includes the credentials commitment as username and password. You are required to use a strong password. If a weak password is used, your account may be suspended until you agree to use a more secure password. Audits can be performed to avoid the use of weak passwords. If an audit is conducted and your password is found to be weak, we will notify you and give you time to change / update your password.

3a.) Zero tolerance spam policy *
We adopt a zero tolerance stance against sending unsolicited emails, mass emails and spam. “Safe lists” and “double subscription” will be treated as spam. Any user who sends spam will have their account canceled with or without prior notice.

Sites advertised through SPAM (Spamvertised) may not be hosted on our servers. This provision includes, but is not limited to SPAM sent by fax, email, instant messaging or usenet / newsgroups. No organization or entity included in the ROKSO can be hosted on our servers. Any account that results in our IP space being blacklisted will be immediately suspended and / or canceled.
mogrexhost.com reserves the right to demand changes or disable, as necessary, any website, account, database or other component that does not comply with its established policies, or to make such modifications in case of emergency at its sole discretion .
mogrexhost.com reserves the right to charge a cleaning fee to the account holder used to send any unsolicited email. This cleaning fee cost is entirely at the discretion of mogrexhost.com.3b.) Domain name abuse *
You, the registrant, agree to provide, maintain and update the current, complete and accurate information of the Whois Registry and all data elements on the domain name during the term of the domain name / order / service. You, the registrant, accept that inaccurate or unreliable information is provided, and / or the failure of the registrant to update the information in a timely manner, or failure to receive a response for more than five (5) calendar days at Inquiries sent to the email address of the registrant or any other contact listed for the domain name regarding the accuracy of the contact information associated with the domain name will constitute a violation of this Agreement and a basis to freeze, suspend or delete that domain / service name.
4.) Payment information *
You agree to provide appropriate payment for services received from mogrexhost.com, prior to the period of time during which such services are provided. You agree that up to and unless you notify mogrexhost.com of your desire to cancel any or all services received, such services will be billed on a recurring basis.
Cancellations must be made in writing through the cancellation form provided. Once we receive your cancellation and have confirmed all the necessary information with you by email, we will inform you in writing (usually by email) that your account has been canceled. Your cancellation confirmation will contain a ticket / tracking number on the subject for your reference and for verification purposes. You should immediately receive an automatic email “Your request has been received …” with a tracking number. An employee will confirm your request (and process your cancellation) shortly after. If you do not receive news from us, or do not receive the automatic confirmation email within a few minutes after sending your cancellation, contact us immediately by phone. We require that service cancellations be made through the online form to (a) confirm your identity, (b) confirm in writing that you are prepared to delete all files / emails and (c) document the request. This process reduces the likelihood of errors, fraudulent / malicious requests and ensures that you know that files, emails and accounts can be deleted immediately after a cancellation request is processed.
As a customer of mogrexhost.com, it is your responsibility to ensure that your payment information is up to date and that all invoices are paid on time. mogrexhost.com provides a grace period of 7 days from when the bill expires and when it must be paid. Any invoice due for 7 days and not paid will result in a late payment charge and / or a suspension of the account until the account balance has been paid in full.

It is the client’s responsibility to confirm that the domain name / hosting / services paid during the activation or renewal is successful verifying that your CPanel area is loading without problems or checking their domains that are registered to confirm the registration or renewal of the domain within 24 hours after a payment confirmation or a renewal of service confirmation, especially when using automated online payment options such as Interswitch or Bank Transfers, to avoid loss of data on the termination of the hosting package / service or Loss of domain name due to expiration.
mogrexhost.com reserves the right to change the amount of the annual payment and any other charges at any time.
5.) Backups and data loss *
Your use of the service is at your own risk. mogrexhost.com is not responsible for the files and / or data that reside in your account. You agree to assume full responsibility for the transferred files and data and keep all appropriate backup copies of the files and data stored on mogrexhost.com servers.
6.) Cancellations and refunds *
mogrexhost.com reserves the right to cancel the account at any time with or without notice.
Any abuse of our staff in any medium or format will result in the suspension or termination of your services.
Customers can cancel at any time through a cancellation form.
The following payment methods are non-refundable and refunds will be recorded as credit in the accommodation account:
- Bank transfers
- Secured Card Online Payment
There are no refunds on dedicated servers, administrative fees, installation fees for custom software or domain name purchases.
Only accounts for the first time are eligible for a refund. For example, if you have had an account with us before, canceled and registered again, you will not be eligible for a refund or if you have opened a second account with us.
Violations of the Terms of Service will void the refund policy (if applicable).
7a.) Use of resources *
The user cannot:
a) Use 25% or more of the system resources for more than 90 seconds. There are numerous activities that could cause such problems; These include: CGI scripts, FTP, PHP, HTTP, etc.
b) Execute independent and unattended processes on the server side at any time on the server. This includes each and every one of the demons, such as IRCD.
c) Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.
d) Run any software that interacts with an IRC (Internet Relay Chat) network.
e) Run any bitstream application, tracker or client. You can link legal torrents off-site, but you cannot host or store them on our shared servers.
f) Participate in any file sharing / peer to peer activity
g) Run any game server such as counter-strike, half-life, battlefield1942, etc.
h) Execute cron entries with intervals of less than 15 minutes
When using PHP, include functions to include a local file, include the local file instead of the URL. Instead of include (“http://yourdomain.com/include.php”) use include (“include.php”)
7b.) TOILETS *
The use of more than 50,000 inodes in any shared account may result in a suspension. Accounts that exceed the 50,000 inode limit will be automatically removed from our backup system to avoid excessive use. Each file (a web page, image file, email, etc.) in your account uses up to 1 inode.
Sites that slightly exceed our inode limits are unlikely to be suspended; however, accounts that constantly create and delete large amounts of files on a regular basis, have hundreds of thousands of files or cause file system damage can be marked for review and / or suspension.
The main cause of excessive inodes seems to be because users leave their general address enabled, but never verify their primary account mailbox. 8.) Use of bandwidth *
You are assigned a monthly allocation of bandwidth. This allowance varies depending on the accommodation package you buy. If your account approves the amount allocated, we reserve the right to suspend the account until the beginning of the next assignment, suspend the account until more bandwidth is purchased at an additional cost, suspend the account until you upgrade to a higher level package, finalize the account and / or charge an additional fee for surpluses. The unused transfer in one month cannot be transferred the following month.
9a.) Money back guarantee *
We reserve the right to reimburse a prorated amount or no refund.
9b.) Activity time guarantee *
If your shared server / reseller has a physical downtime that is not within 99.9% uptime, you can receive a credit month in your account. Credit approval is at the discretion of mogrexhost.com depending on the justification provided. Third-party monitoring service reports cannot be used for justification due to a variety of factors, including the monitor’s network capacity / traffic availability. Server uptime is defined as the uptime reported from the operating system and the Apache web server that may differ from the uptime reported by other individual services. To request a loan, contact email@example.com with justification. All requests must be made in writing via email. Uptime guarantees only apply to shared solutions / resellers. Dedicated servers are covered by a network guarantee in which the credit is prorated for the amount of time the server is down that is not related to our uptime guarantee.
10.) Reseller: Customer Responsibility *
Resellers are responsible for supporting their customers. mogrexhost.com does not support the Customers of our Distributor. If a reseller’s client contacts us, we reserve the right to put the client’s account on hold until the reseller can assume responsibility for his client. The reseller must make all support requests on behalf of his clients for security reasons. Resellers are also responsible for all content stored or transmitted under their reseller account and the actions of their customers. mogrexhost.com will hold any reseller responsible for any of the actions of its clients that violate the law or the terms of service.
11.) Shared servers (accounts without reseller) / Semi-dedicated *
Shared accounts cannot resell web hosting to other people, if you want to resell the hosting you must use a reseller account. Semi-dedicated servers are not supported. You must keep your own backups.
12.) Dedicated servers *
mogrexhost.com reserves the right to reset the password on a dedicated server if the password in the file is not updated so that we can perform security audits as required by our data center. It is the client’s responsibility to ensure that there is a valid email address and a current root password in the file for their dedicated server in the file to avoid downtime by forced password reset. mogrexhost.com reserves the right to audit servers as necessary and perform administrative actions at the request of our data center. Dedicated servers are NOT supported by us and it is the client’s responsibility to keep backup copies or have a solution for this. You can buy an additional hard drive and keep backups as the simplest solution. Contact firstname.lastname@example.org if you want to obtain a secondary hard drive. It is your responsibility to keep backup copies.
13.) Membership terms and conditions *
For customers who want to be part of our affiliate system. These policies apply:
- You can’t refer to yourself.
- Commissions are one-time.
- The opening of several accounts by the same client is not allowed and may lead to the suspension of your account.
- The affiliate is credited with an initial sum of N500.
- The affiliate can obtain up to 20% on each product / service paid (that is, only accommodation) and 5% on each reseller account paid after 35 days of maturity.
- The affiliate can only withdraw after reaching the N3000 mark. The affiliate may decide to add these funds to their customer account.
- Money withdrawn by the affiliate will be deposited into any bank account in Nigeria within 5 business days.
- The money withdrawn would be paid to an account with the name of the affiliate.
- Two or more affiliate accounts cannot be combined.
14.) Price change *
We reserve the right to change the prices listed on mogrexhost.com, and the right to increase the amount of resources allocated to the plans at any time.
15a.) Compensation *
The client accepts that he will defend, indemnify, save and keep mogrexhost.com harmless from each and every one of the demands, responsibilities, losses, costs and claims, including the reasonable fees of lawyers claimed against mogrexhost.com, its agents, its clients , officials and employees, which may arise or be the result of any service provided or performed or agreed to be performed or any product sold by the client, its agents, employees or assignees. The client agrees to defend, indemnify and disclaim mogrexhost.com against the responsibilities derived from; (1) any injury to a person or property caused by any product sold or otherwise distributed in connection with mogrexhost.com; (2) any material supplied by the customer that infringes or allegedly infringes the property rights of a third party; (3) copyright infringement and (4) any defective product sold to customers from the mogrexhost.com server.
15b.) Arbitration *
By using any mogrexhost.com service, you agree to submit to binding arbitration. If disputes or claims arise against mogrexhost.com or its subsidiaries, such disputes will be handled by a choice arbitrator of mogrexhost.com. An arbitrator of the Nigerian Arbitration Association. The arbitrators will be retired lawyers or judges and will be selected in accordance with the applicable regulations. All decisions issued by the arbitrator will be binding and final. The arbitration award is final and binding on all parties. The Federal Arbitration Law, and not any state arbitration law, governs all arbitration under this Arbitration Clause. It is also responsible for all costs related to such arbitration.
16.) Disclaimer *
mogrexhost.com will not be responsible for the damages that your company may suffer. mogrexhost.com does not offer guarantees of any kind, express or implied by the services we provide. mogrexhost.com disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data as a result of delays, no deliveries, incorrect deliveries and any interruption of service caused by mogrexhost.com and its employees. mogrexhost.com is not responsible for damages, events that may occur as a result of the use of our services, downtime, failure or refusal to register or renew your services with us.
17.) Disclosure to the police *
mogrexhost.com may disclose any subscriber information to law enforcement agencies without further consent or notification to the subscriber at the legal request of those agencies.
We will cooperate fully with law enforcement agencies.
18.) Changes to TOS *
mogrexhost.com reserves the right to review its policies at any time without prior notice.
